UCMJ, The Army and Civilian Court...Can anybody answer this question for Me.?

My wife and I got into an argument so she got upset and called the cops here in El Paso, TX. She told the cops that I hit her after they arrested me she told them the truth and said I really didn't hit her she was just upset but the DA said to arrest me anyway. She wrote a sworn statment for my Platoon Leader saying I did not hit her and told ACS family advocacy that I didn't hit her as well. I hired a lawyer and he said that there is a 90% chance that he will have the charges expunged but my Battalion Commander wants to Chapter me out the Army for unbecoming as an NCO based on this issue. If the charges are dropped on the civilian side and that sworn statement that she wrote, can he still Chapter me out the Army?
